What not to do when making art: The usage of the word Phish and images of Band Members

A lot of people ask and even more don’t, but one issue on the Phish lots is what IS and IS NOT ok to sell.  More so, what is the cause for some lot items to be taken, and others not.  This Treatise on Phish Lot is designed to share with you the rationale behind the usage of the word Phish, as well as the usage of the images of band members on your posters, shirts and stickers or whatever it is you make and sell/share in the lots and online.

**Note** This blog post is not meant to be an end all/be all for defense from those who would take away your lot art or other art for that matter.  Do not present this blog post as your defense, it is only a guide based upon experiences in the lots and having been on tour for years. The writer of this is not a lawyer, although he did once play one in high school.

The word “Phish”

The word “Phish” is a federally registered trademark that the band holds, and therefore it gives the band the exclusive right to use the word Phish (their trademark) on particular goods and services, including posters, decals, bumper stickers, clothing, and so on. Trademarks are a great asset to a band, big or small.  If trademarks are not enforced, then they would cease to exist.

Photographs

In recent years, fans have taken to selling their photos of the band. Phish does not allow any commercial use of band or band member names, images or likenesses without permission. That includes sale and/or commercial use of photographs.

So you are thinking of making a poster, a shirt, or a sticker for sale in the lots or online.  And you wonder, “If I draw a picture of Page/Fish/Mike/Trey will I get in trouble for it?”

The answer is Yes, sort of.

Who are these guys? I dont know, look like four random people to me.  The chick on the right looks a little husky though. Second one in from the left is decent.  Dude in the hat looks like Waldo, can’t be sure though.

Wait, you say these are Page, Fish, Trey and Mike? Wha? Well, I guess thats possible.  But thats the point here: the vagueness of this shirt, the lack of anything that tells you who they are such as their name or facial features – those keep this shirt totally in the black (black is good). This is a creative shirt in that respect, in that it avoids any conflict with Phish’s trademarks and leaves no real aspect of the shirt’s design to complain about.

In terms of likenesses, this has a good deal of gray/grey area. First, if you are selling something or making something that might imply some sort of endorsement by the band member’s likeness you feature, then you are most likely violating that band member’s right to privacy/publicity (That’s based on individual state’s laws, most of which protect reproductions of likenesses.)

Even though you could argue that the likeness of a band member on an original work or a limited edition art-print is OK, the people patrolling the lots are most likely not going to get into a legal debate with you, discuss abstract copyright law, or indulge you in an opportunity to defend yourself. They are not really interested in discussing what is a likeness and what isn’t, and before you know it they will use their power granted by a U.S. Attorney and the U.S. Marshal’s Service. To be blunt – they will tend to grab anything with a band-member’s likeness on it.

Remember Hampton? Wasn’t that fun?  Everyone had shirts, posters, stickers, it was a free-for-all!

In every town Phish plays in, a new order of seizure is filed for and (typically) granted to Phish’ management, a deputization of sorts, where they legally can seize your goods, or at least make you run really fast to avoid them. This has been done for years, at least 15 by our count. However, in Hampton, someone dropped the ball, didn’t file the papers right, or didn’t dot an ‘i’ somewhere. That is why we had free reign in Hampton. But it is also why we will probably not have free reign, or anything close to it, ever again. Phish only drops the ball once. Or twice, depending on how you viewed the hiatuses.

But what about artistic ingenuity?
Artistic ingenuity is great and all, and if you paint Trey with a brush, it’s art. But it’s still Trey’s image, and there is a right to privacy inherent, no matter if you are famous or not.

Just remember, it’s all about being creative, but more about being REALLY creative and using other aspects of the band: the songs, the lyrics, the venue they play in, the cities the find themselves in, the overall event, those are legit from our experiences. The more creative you are, the better your lot shirt/poster/sticker will come out! Find other ways to make a poster about Phish, a lot-shirt that doesn’t get you in hot water, or a sticker that doesn’t go to waste because you figured your logic trumps a judge’s order of seizure. Play it smart, be creative, enjoy the lots, and dont patronize the nitrous mafia. They are a leech on Phish Lot.

AJ Masthay Albany print – ‘Terror Gnome’

With fall tour comes yet another Amazing AJ Masthay print!

The first of a few prints he is releasing for this tour is “The Arena”.  Although you could call it The Times Union Center, The Pepsi Arena, or everyone’s favorite, the original, The Knick(erbocker) Arena. For this poster, just for brevity’s sake, AJ sticks “The Arena”

With 8 colors total, this is a poster with a smaller edition of 75. The ink on these is extra thick, so it looks like that super shiny, raised off the paper, stink that runs up your nostrils thick. Good stuff.

Masthay is looking to convey a sense of autumn, hence the wooded path. This poster more than others in his collection tells a story, but what is happening in the story is up to your imagination.  What is the book in the gnome’s hands? The HPB? PhanArt? Dianetics? ? Is he walking towards you or away from you? Is he being chased? These questions are best pondered and answered by picking up the poster.  Order info below.

Drew Suto’s Albany Art

Drew Suto, Artistic Designer for Surrender to the Flow, father and husband and all around good friend has created a run of posters featuring his art from the cover of Surrender To The Flow #23.

A hometown show for Drew as well as PhanArt Pete and many other hundreds of phans, Drew’s art is inspired by his hometown, as well as that little burgh south of us we call ‘The City’

Indoor Lot at the OnCenter Before 11/22 Syracuse Show – Free for Vendors and Phans!

Some very intelligent folks who rune the OnCenter Complex in Syracuse have come up with a great idea: an indoor lot scene that is free for phans to take part in, selling their lot goods inside, away from the cold Syracuse winter (it comes early, trust me)

Inside the OnCenter from 9am-730pm will be vendors such as SoundGarden (Cuse’s own great record store), Henna tattoo Artists, Massage Therapist, Tarot Card readers, (beer) Belly Dancers (10 heady points if you know that song reference) and many book vendors.

Fans can vend too!  This is your pre-show too!  It is FREE for you to take part! So if you have something to sell, whether it be clothing, art, or something else. PhanArt will be there selling the book, shirts, stickers and posters, as well as displaying some of the latest fan-art from 8! To register, all you need is to contact Michelle at the OnCenter at 315-435-8000 to register and you are in! No Cost! No Fee! No Fee? Maybe a Fee during the Phish show, that would be heady. Been since 7/29/03 since I caught one.

But I digress…..

Phish fans can come to the OnCenter, check out the scene inside, and listen to some local bands, including The Lost Marbles, Soul Risin‘, and Dark Hollow (on stage from 2-6pm – this will be an AWESOME pre-show)

It’s gonna be cold, cold, cold, cold in the ‘cuse, so take advantage of this indoor, warm environment to sell your wares and make some money for tour!

Note: Glass vendors- sorry, no dice on this. I checked with them and they just aren’t cool like that. Sorry, but they just wouldn’t say yes.

SYRACUSE, NY – Onondaga County’s Oncenter will host a free Pre-Phish Party prior to the Nov. 22 Phish concert at the War Memorial Arena.
The party will be inside the Nicholas J. Pirro Convention Center, next door to the War Memorial, starting at 9 a.m. It will last until the start of the show starts at 7:30 p.m, Oncenter officials said in a press release.

The goal is to create a place for these fans to hang out and escape the weather prior to the show. “We want to show the community and the promoters that we care and we’re willing to go the extra mile to make fans truly have an experience when they come to an event at our facilities,” said Mike Spaulding, director of ticketing and event bookings for Oncenter.

Admission is free and entertainment includes live music from local bands, vendors and contests. One Pre-Phish Party attendee will win a pair of tickets to the see the sold-out concert.

Local bands will play starting at 11 a.m. Food, beer and other items will be available.

Oncenter officials urged those planning to attend the party to bring lawn chairs and blankets.

What is and isn’t legit to sell on Phish lot

So many people sell things, and so many people want to sell things on the lot. But what is legal, what is legit, what is illegal, what is illegit, what is 2 legit 2 quit, and what is safe for all? We go over in great detail the things you can and cant sell on lot.

(Note – this does not serve as any sort of 100% iron-clad, use-as-defense-in-court sort of advice – this is based upon the opinion on many dozens upon dozens of artists, fans and average brahs that have sold something on the lot. we still recommend you proceed with caution – each venue and town is unique and we cannot take that into account)

What you can sell almost always:

Water, light food, things that are easily disposable or pose no threat to local businesses – for example, if there was a grilled cheese store, you wouldnt want to sell grilled cheese outside of it. Ditto with selling beer and water outside a convienence mart – its risky, but typically you dont get hassled.

also, things like lighters, cigs, clothing that isnt Phish related (see below) and generic stuff that isnt at ALL Phish related

What you can sell sometimes:

Phish related Lot shirts, Show Posters, Stickers (almost always ok), larger arrangements of food (Russo’s French Bread Pizza and larger Shakedown vendors), typically beer, but it is recommended that you be 21+ and for the love of god, 1 for 3, 2 for 5!

What you should never sell on the lot:

Children

A Dodge Dart

Religion

Snuggies

Jerry’s ashes

Nitrous – seriously, it’s a bit out of hand

What you can not sell on lots:

Phish posters or shirts that have any of these on them and a word on each:

The band’s name, as it is trademarked and as such, the name cant exactly be put on posters or shirts without the band having their name infringed upon. As such, using the band’s name is risky. We do not advise it, as most of the busts seen this summer by venue security and/or Phish staff was related to this. Or the least creative idea….

The logo.  Why use the logo? This is the design (supposedly) created by Trey and is iconic. Do you really have to manipulate the logo to be creative? This is an automatic non-starter. I highly suggest NOT using the logo, or even the outline.  Why? Because it’s unoriginal and ripping the band off directly. These are the items most often confiscated in our experience, and no, we have not used the logo. We didnt even accept the logo for PhanArt: The Art of the Fans of Phish, but boy oh boy, there were a lot of bad ripoffs submitted.  Use of the logo is the least creative idea, and is definitely grounds for confiscation of your lame-idea-turned-moneymaker. Don’t bother. Seriously.

Photographs of the band, whether close up or from far away. Phish does not allow any commercial use of band or band member names, images or likenesses without permission. That includes sale and/or commercial use of photographs.

Lastly, the band’s likenesses. This is a gray/grey area that I discuss, but I understand that it’s the band member’s image that is in question.  If it is tasteful, sure. If it is vague (see below), awesome! If it is a picture of the band from a promo photo, then again, that is unoriginal.

If you can avoid those three things, you shouldnt have a problem.

Also, we here at PhanArt do not condone the sale of bad drugs, fake drugs, or drugs that make your face melt when the music isn’t even playing. Please, use substances responsibly, and in a manner that doesn’t ruin anyone else’s  good time, or your good time for that matter.
